Congress Wants AI Data Centers to Pay Their Fair Share of the Power Grid
The AI buildout is getting its first real rulebook in Washington. On September 11, Rep. Suhas Subramanyam introduced the National Data Center Plan, a package of four bills covering where data centers get built, how their energy and water use gets measured, how nearby communities get protected, and who pays for grid upgrades.
The pricing bill is the one to watch. The Data Center Fair Share Act would require data centers and other large energy consumers to cover the full cost of grid upgrades, pushing states to adopt large load tariffs so the power these facilities consume is priced honestly. Yale research from Ryan Wang estimates that adding 100 megawatts of data center capacity raises residential fixed electricity charges by 0.7 percent in regulated markets, and the 4.1 gigawatt Stargate build in Texas shows how fast those numbers scale.
Local organizing is driving the response. State lawmakers introduced at least 375 bills on data centers this year, more than the previous three years combined, with roughly three quarters aiming to restrict new development. Ireland has restricted new connections around Dublin, the Netherlands limits where data centers can be built, and New York imposed a one year moratorium on facilities drawing 50 megawatts or more.
The flip side is the opportunity. A Reuters Breakingviews analysis published today puts roughly 158 gigawatts of US data center capacity and 66 gigawatts in Europe in the pipeline, and says hyperscaler spending could reach about 3 percent of US GDP annually from 2027 to 2029. Construction is short roughly 439,000 workers, electricians moving to data center projects are seeing salary bumps of 25 to 30 percent, and the 2025 deal by Brookfield and Cameco to build at least 80 billion dollars of new Westinghouse nuclear reactors shows the scale of the response.
The debate is going global. The UN Economic Commission for Europe has called for stronger oversight of data center expansion, and communities from Dublin to Virginia are writing the playbook for how growth gets negotiated. Clear rules, honestly priced power, and local consent are becoming the standard asks on every continent.
Brookings research adds a useful distinction. Facilities built by specialized landlords mostly serve remote users, while campuses built by hyperscalers tend to create lasting tech hubs, as Northern Virginia and Dublin show. Communities that welcome the buildout with clear terms get the lasting version.
For anyone living near a planned site, the fair share principle is the thing to rally around. Honest power pricing, measured water use, and a seat at the table. The AI era gets built faster when communities help shape it.
